This Privacy Policy explains how Marsha Vanwynsberghe, a sole proprietor based in Ontario, Canada ("we," "us," "our," or "Marsha"), collects, uses, discloses, and safeguards your personal information when you visit marshavanw.com (the "Site"), subscribe to our newsletter or podcast, purchase a digital product, or enrol in a coaching program such as the UNBOTHERED™ Entrepreneur Mastermind (collectively, the "Services").

We are committed to protecting your personal information in accordance with the Canadian Personal Information Protection and Electronic Documents Act (PIPEDA), applicable provincial privacy laws, and other applicable privacy laws where relevant to you, including the EU/UK General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA) as they apply.

By using the Site or Services, you consent to the collection, use, and disclosure of your personal information as described in this Policy. If you do not agree, please do not use the Site or Services.

1. Information We Collect

1.1 Information You Provide Directly

We collect personal information that you voluntarily provide to us when you interact with the Site or Services. This may include: 

  • Identity and contact information: name, email address, phone number, mailing address, and country/region;
  • Account information: username, password, profile photo (if you provide one), and login credentials for our member portal;
  • Payment information: billing name, billing address, and the last four digits of your payment card. We do not store your full credit card or banking details — these are collected and processed directly by our payment processors (such as Stripe and Kajabi);
  • Program participation information: responses to intake questionnaires, workbook content you choose to share, questions and shares on live calls, messages posted in the Telegram community, and correspondence with Marsha or her team;
  • Marketing information: your communication preferences, responses to surveys, and information submitted through newsletter, freebie, or contest forms;
  • Testimonials and feedback: any testimonial, review, or story you voluntarily submit.

1.2 Information Collected Automatically

When you visit the Site, we and our service providers automatically collect certain technical information, including: 

  • Device and connection information: IP address, device type, operating system, browser type and version, screen size, and referring URL;
  • Usage information: pages visited, time spent on pages, links clicked, search terms used, and general interaction patterns;
  • Cookies and similar technologies: see Section 5 for details.

1.3 Sensitive Information

In the course of participating in a coaching Program, you may choose to share personal stories, emotional experiences, information about your family, health, finances, or other sensitive topics. We do not require you to share any specific sensitive information, and you should share only what you are comfortable sharing. Any such information is treated with confidentiality in accordance with this Policy and the confidentiality provisions of our Terms and Conditions. 

1.4 Children

Our Services are intended for adults aged 18 and over. We do not knowingly collect personal information from children under 16. If you believe a child has provided us with personal information, please contact marsha@marshavanw.com and we will take steps to delete it. 

2. How We Use Your Information

We use your personal information for the following purposes, which we consider to be our legitimate business interests, with your consent, or as otherwise permitted by law: 

2.1 To Deliver the Services

  • Creating and managing your account and portal access;
  • Processing payments and delivering the products and programs you purchase;
  • Hosting and recording live coaching calls, managing community channels, and providing you with program materials;
  • Responding to your questions, requests, and support inquiries;
  • Sending transactional communications (receipts, call reminders, schedule updates, portal instructions, and similar).

2.2 To Communicate With You

  • Sending newsletters, podcast announcements, blog updates, and information about our products and programs (where you have consented in accordance with Canada's Anti-Spam Legislation, "CASL");
  • Conducting surveys, running promotions, and offering content we believe may be of interest to you;
  • Notifying you of changes to our Terms, Privacy Policy, or Services.

2.3 To Improve Our Services

  • Analyzing how visitors use the Site to improve content, navigation, and offerings;
  • Understanding which marketing efforts are effective;
  • Developing new products, programs, and features;
  • Aggregating and anonymizing data for research and reporting.

2.4 To Protect Our Business and Comply with Law

  • Preventing fraud, unauthorized access, and abuse;
  • Enforcing our Terms and Conditions, including pursuing unpaid balances;
  • Complying with legal obligations and responding to lawful requests by public authorities;
  • Establishing, exercising, or defending legal claims.

3. How We Share Your Information

We do not sell your personal information. We share it only in the limited circumstances described below:

3.2 Legal and Safety Reasons

We may disclose personal information when we believe in good faith that disclosure is necessary to: (i) comply with a legal obligation, subpoena, or court order; (ii) protect our rights, property, or safety, or those of our clients or the public; (iii) investigate, prevent, or take action regarding suspected fraud, security issues, or violations of our Terms; or (iv) enforce our agreements. 

3.3 Business Transfers

If the business is sold, merged, or transferred to another owner, your personal information may be transferred as part of that transaction, subject to the acquirer agreeing to honour the commitments in this Privacy Policy. 

3.4 With Your Consent

We may share your information in other circumstances with your express consent — for example, when you agree to have a testimonial or story featured publicly. 

3.5 Within the Program Community

When you enrol in a group program, your name, your shares on live calls, and your posts in community channels (such as Telegram) are visible to other enrolled participants. By enrolling, you consent to this visibility. Other participants are contractually required to keep your shares confidential under our Terms and Conditions, but we cannot guarantee their compliance. 

4. International Transfers of Personal Information

We are based in Canada, and many of our service providers are located in the United States and elsewhere. When you provide us with personal information, it may be stored or processed in jurisdictions outside your own, including the United States. These jurisdictions may have privacy and data protection laws different from those in your home jurisdiction. While information is in another jurisdiction, it may be accessible to foreign courts, law-enforcement, and national-security authorities under the laws of that jurisdiction. 

We take reasonable steps — including through contractual safeguards with our service providers — to ensure that your information receives a level of protection comparable to that provided under Canadian privacy law. 

5. Cookies and Tracking Technologies

We and our service providers use cookies, pixels, web beacons, and similar technologies on the Site. Cookies are small data files stored on your device that help websites function, remember your preferences, and analyze traffic. 

5.1 Types of Cookies We Use

  • Strictly necessary cookies: required for core site functionality, such as logging into the member portal and processing checkout;
  • Functionality cookies: remember your preferences (for example, whether you've dismissed a banner);
  • Analytics cookies: help us understand how visitors use the Site (for example, Google Analytics);
  • Advertising and retargeting cookies: support marketing activities on platforms such as Meta (Facebook/Instagram) and Google, including the Meta Pixel used to measure advertising effectiveness.

5.2 Managing Cookies

Please note that disabling certain cookies may affect site functionality (for example, you may not be able to log in). 6. Email and Marketing Communications (CASL)

In accordance with Canada's Anti-Spam Legislation (CASL), we will only send you commercial electronic messages where you have provided express or implied consent, or where we are otherwise permitted to do so by law. Every commercial email we send will include: 

  • A clear identification of the sender;
  • Valid contact information; and
  • A functioning unsubscribe mechanism that allows you to opt out of future marketing communications at no cost.

You may withdraw your consent at any time by clicking the unsubscribe link in any marketing email we send, or by contacting us at marsha@marshavanw.com. Please note that even if you unsubscribe from marketing emails, we may still send you transactional messages related to a program or product you have purchased.

7. Your Rights and Choices

7.1 All Individuals

You have the right to: 

  • Access the personal information we hold about you;
  • Request that we correct any inaccurate or incomplete information;
  • Request that we delete your personal information, subject to our legal obligations to retain certain records;
  • Withdraw your consent to the processing of your personal information, where the processing is based on consent (note that withdrawing consent may affect our ability to provide certain Services to you);
  • Lodge a complaint with the applicable privacy regulator.

To exercise any of these rights, email us at marsha@marshavanw.com with the subject line "Privacy Request." We will respond within thirty (30) days, or as required by applicable law.

7.2 EU/UK Residents (GDPR)

If you are located in the European Economic Area (EEA), United Kingdom, or Switzerland, you have additional rights under the GDPR and UK GDPR, including the rights to data portability, to object to processing based on our legitimate interests, and to restrict processing in certain circumstances. Our legal bases for processing are: (i) your consent; (ii) the performance of a contract with you; (iii) compliance with a legal obligation; and (iv) our legitimate business interests (for example, marketing our own similar products to existing clients and preventing fraud). 

7.3 California Residents (CCPA)

If you are a California resident, you have additional rights under the California Consumer Privacy Act, including the right to know what personal information we collect and share, the right to request deletion, and the right to opt out of the "sale" or "sharing" of your personal information. We do not sell personal information. To exercise your CCPA rights, email marsha@marshavanw.com with "California Privacy Request" in the subject line. 

7.4 Filing a Complaint

If you are not satisfied with how we have handled your personal information, you may file a complaint with the Office of the Privacy Commissioner of Canada at priv.gc.ca, or with the applicable privacy regulator in your province or country of residence. 

8. How We Protect Your Information

We use reasonable administrative, technical, and physical safeguards to protect personal information against loss, theft, unauthorized access, disclosure, copying, use, or modification. These safeguards include encrypted connections (SSL/TLS), secure password protocols, access controls that limit who on our team can view personal information, and the use of reputable third-party providers with their own security programs. 

No method of transmission over the internet or method of electronic storage is completely secure. While we strive to protect your personal information, we cannot guarantee absolute security. You are responsible for keeping your password confidential and for notifying us immediately of any unauthorized use of your account. 

9. How Long We Keep Your Information

We retain personal information only for as long as necessary to fulfil the purposes for which it was collected, to comply with our legal, accounting, or reporting obligations, and to establish, exercise, or defend legal claims. In general: 

  • Account and portal data is retained while your account is active and for a reasonable period after cancellation or program completion so that you can access purchased materials;
  • Financial and transaction records are retained for the period required by Canadian tax and financial-reporting law (typically at least six years);
  • Marketing-list data is retained while you remain subscribed and for a reasonable period thereafter;
  • Call recordings are retained for the duration of a Program and made available in the member portal for access by enrolled participants.

When retention periods expire, we securely delete or anonymize the information.

10. Third-Party Websites and Services

The Site may contain links to third-party websites, social media platforms, or services that are not operated or controlled by us. This Privacy Policy does not apply to third-party sites or services, and we are not responsible for their privacy practices. We encourage you to review the privacy policy of any third-party site you visit. 

11. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, or business operations. When we make material changes, we will update the "Last Updated" date at the top of this Policy and, where appropriate, provide additional notice by email or through a notice on the Site. Your continued use of the Site or Services after changes are posted constitutes your acceptance of the updated Policy.
